

If the petitioner is a stay at home mom, and is suing the non-custodial parent for not paying half of a $10 medical bill from two months prior, can she get attorney fees? This is really happening, I canapos;t make this stuff up.
She also thinks he owes for braces from two years prior.
The orders for support included assumed arrears. The arrears were for $1,744. This was for oct apos;06 through jan apos;07. Support was and is 436/m. So the arrears covers the full amount of support owed during that time.
$1,405 was actually paid in support for that time period in between the child support orders begining and the earnings assignment taking affect. So 1405 was overpaid, correct? His owed half of braces was $762.5 So the extra money should have gone towards medical expenses incured at that same time period, right? And then there would still be money left over which he never asked for back. The non-custodial parent also has another child to support by the way.
My question beside would he have to pay attorney fees is does he still owe $762.5 for braces? Support was ordered as high as possible at that time. With gross income at $1940/m and hmo premiums for the child being $46(his half $23 added on) Extra money seems unfair when the non-custodial has another child to support as well.
Does it make any difference that the non-cust. Parnet doesnapos;t make enought money after taxes and current support the pay his own bills?
